1. Agreement to these terms
These Terms & Conditions (“Terms”) are an agreement between you and DeployMonitor, a remote company headquartered in Kelowna, British Columbia, Canada (“DeployMonitor,” “we,” “us,” or “our”). By creating an account or accessing or using the service, you agree to these Terms and our Privacy Policy.
If you use DeployMonitor for a company or other organization, you represent that you have authority to accept these Terms for that organization.
2. Eligibility
You may use DeployMonitor only if you have reached the age of majority under the laws where you live and have the legal capacity to enter into a binding agreement. You may not use the service if applicable law prohibits you from doing so.
3. Accounts and security
You must provide accurate account information, keep it current, protect your password, API tokens, recovery codes, and other credentials, and promptly notify us if you suspect unauthorized account use. You are responsible for activity performed through your account unless applicable law provides otherwise.
Project owners and administrators may invite other users and assign project roles. You are responsible for inviting only authorized people, assigning suitable access, and managing or removing that access when it is no longer required.
4. The beta service
DeployMonitor offers new users a 14-day free trial. No credit card is required, and DeployMonitor does not currently charge for access. While pricing is unavailable, we may extend free beta access beyond the initial trial. Any extension does not guarantee continued access or a future free plan. Beta functionality may be incomplete, change materially, contain errors, or be discontinued.
Before charging you, we will provide the applicable prices, plan limits, billing terms, renewal rules, taxes, cancellation rights, and refund policy, and obtain any authorization required by law. These Terms do not authorize us to charge you for the current trial or extended free beta access.
5. Permitted use and monitoring authorization
You may use DeployMonitor to manage authorized project history, monitor public HTTP or HTTPS endpoints, review certificate and domain-health information, schedule maintenance, generate reports, collaborate with project members, and connect permitted deployment workflows through project-scoped API tokens.
You may configure monitoring only for websites, domains, and endpoints that you own, operate, or are otherwise authorized to monitor. You authorize DeployMonitor to send automated requests to configured endpoints and to process the resulting technical information for the service.
6. Acceptable use
You must not use DeployMonitor to:
- violate applicable law or another person's rights;
- monitor, probe, or access systems without authorization;
- upload or transmit malware, malicious code, or content designed to compromise the service or another system;
- send spam, abusive messages, or misleading invitations;
- attempt to bypass rate limits, access controls, destination-safety controls, or other technical restrictions;
- interfere with the service or place an unreasonable load on DeployMonitor or third-party infrastructure;
- use API tokens outside their authorized project or disclose them to unauthorized people;
- impersonate another person, misrepresent your affiliation, or use the service for fraud; or
- copy, reverse engineer, or exploit the service except to the extent that applicable law does not permit that restriction.
7. Your content
You retain ownership of project information, logs, maintenance details, reports, profile images, and other content that you submit to DeployMonitor (“Customer Content”). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, back up, and otherwise process Customer Content, including through service providers acting for us, only as reasonably necessary to operate, secure, support, and back up the service and meet our legal obligations. This license lasts only while we retain Customer Content for those purposes.
You are responsible for Customer Content and for having the rights and permissions needed to submit it. Do not include sensitive personal information or confidential material that is not reasonably necessary for your use of the service. Shared-report links may allow anyone who possesses the link to view the corresponding report; you are responsible for distributing and managing those links appropriately.
8. DeployMonitor intellectual property
DeployMonitor and its software, designs, branding, documentation, and other service materials are owned by us or our licensors and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service. No other rights are granted to you. Feedback you voluntarily provide may be used to improve DeployMonitor without an obligation to compensate you.
9. Third-party services
DeployMonitor relies on third-party infrastructure and communication providers, including Amazon Web Services and Cloudflare. Third-party websites, monitored endpoints, registries, registrars, and services remain governed by their own terms and policies. We are not responsible for third-party services that we do not control.
10. Availability and changes
We may maintain, update, modify, limit, or discontinue parts of the beta service. Monitoring, alerts, reports, domain data, and other outputs may be delayed, incomplete, or inaccurate because of network conditions, third-party systems, configuration, or software errors. DeployMonitor is an operational aid and is not a substitute for your own backups, security controls, incident response, or monitoring appropriate to your needs.
No service-level agreement, uptime commitment, support-response commitment, or service credit applies unless we agree to one separately in writing.
11. Suspension, termination, and account deletion
You may stop using DeployMonitor at any time and can request account deletion through the available profile settings. We may suspend access immediately if we reasonably believe that your use creates a security risk, violates applicable law, involves unauthorized monitoring, threatens harm to DeployMonitor or another person, or involves a material breach that requires immediate action.
For other material breaches, we will provide notice and a reasonable opportunity to correct the breach when practical. We may terminate access if the breach is not corrected or if we discontinue the service. You may contact [email protected] to ask us to review a suspension or termination.
Provisions that by their nature should continue after termination—including ownership, necessary content-license effects, disclaimers, liability provisions, and dispute terms—will survive to the extent applicable.
12. Disclaimers
To the fullest extent permitted by law, DeployMonitor is provided “as is” and “as available.” We and our licensors disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or accurate. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, DeployMonitor and its directors, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the service, even if advised that those damages were possible.
To the fullest extent permitted by law, DeployMonitor's aggregate liability for all claims arising from or related to the service will not exceed the fees you actually paid to DeployMonitor during the 12 months before the event giving rise to the claim. These limitations do not apply to liability that cannot lawfully be limited or excluded.
14. Indemnity
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless DeployMonitor and its directors, officers, employees, and contractors from third-party claims, losses, liabilities, damages, and reasonable legal costs arising from your unauthorized monitoring, unlawful misuse of the service, or Customer Content that infringes or violates another person's rights.
We will promptly notify you of a covered claim, provide reasonable cooperation at your expense, and allow you to control the defense. You may not settle a claim in a way that admits fault by DeployMonitor or imposes a non-monetary obligation on DeployMonitor without our prior written consent, which we will not unreasonably withhold.
15. Governing law and disputes
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to mandatory law, you and DeployMonitor submit to the non-exclusive jurisdiction of the courts of British Columbia. Nothing in these Terms limits your right to bring a claim in a mandatory local forum or use an applicable tribunal, small-claims process, or consumer-protection process. These Terms do not require arbitration or waive participation in a class proceeding.
16. Changes to these terms
We may update these Terms as the service changes, including before introducing paid plans or eCommerce features. We will post updated Terms with a new effective date and provide any additional notice required by law. If a change requires your consent, we will request it before the change applies to you.
17. General
If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver of it. You may not assign these Terms without our prior written consent. DeployMonitor may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of all or substantially all of the business or assets to which these Terms relate, or by operation of law. We will provide notice of an assignment when required by law. These Terms bind and benefit the parties and their permitted successors and assigns.
